NOTE: A civil annulment is different from a religious annulment. If you are seeking to have your marriage annulled so that you can marry again in your church, you may need to pursue a separate process. Talk to your clergy member first — but we have also assisted clients with this process.

Annulling A Marriage In Texas

An annulment is a court decree that essentially ends and erases your marriage. For legal purposes, the marriage never happened and the other party has no legal marital connection to you.

If you have grounds for annulment, you do not have to wait 60 days like an uncontested divorce. Your marriage can be officially annulled inside of a week if both parties agree.

The Texas Family Code sets out grounds for voiding a marriage, including:

  • Consanguinity (spouse is a close family member)
  • Bigamy (spouse is already married)
  • Concealed divorce (spouse was divorced less than 30 days)
  • Waiting period violation (within 72 hours of obtaining marriage license)
  • Under the age of 14
  • Under the age of 18 without parental/guardian consent
  • Under the influence of alcohol or drugs
  • Lack of mental capacity
  • Fraud or misrepresentation
  • Force or duress
  • Sexual impotency (spouse is unable to consummate)

If the other party contests the annulment or if the court is skeptical, you may have to prove grounds in court.
